Refund policy

This Policy governs the terms and conditions regarding refunds, credits, cancellations, and booking transfers for services provided by Territory Motorcycle Training ("Territory Motorcycle Training," "TMT," "provider," "we," "us," or "our"). Nothing in this Policy excludes, restricts, or modifies any rights or guarantees to which you are entitled under the Australian Consumer Law (ACL). By engaging with our services, you agree to the terms set out in this Policy.

1. Bookings and Payments

1.1 Payment Requirement

Full payment is required at the time of booking for all classes, courses, and coaching sessions.

1.2 Transaction Fees and GST

Any applicable transaction fees or Goods and Services Tax (GST) will be clearly shown at checkout.

1.3 Discounted or Promotional bookings

1.3.1 Bookings made during sale periods at promotional pricing are only available for the specific course options and dates published during the sale period. No rainchecks are permitted.

1.3.2 Individual goodwill discounts may be offered at our discretion, for a specific course option and date of delivery, as outlined to you at the time of offering the discount. Goodwill discounts are only valid for the specific course and/or date offered. Acceptance of an offer of a goodwill discount for a specific course or date of delivery does not create any entitlement to future discounts for other courses or dates. Goodwill discounts cannot be applied to already discounted (sale or promotional) offers.

1.3.2. Course bookings made during sale or promotional periods, or otherwise made through an offer of discount by us, are tied to the scheduled course date selected at the time of purchase and cannot be rescheduled to another date. Discounted places are priced on the basis that coaches, venues, and motorcycles are allocated at the time of booking, and those costs are committed to us. This ensures discounted places remain fair and accessible to all riders. All other clauses of this policy relating to refunds and no-shows, including minimum notice periods, apply equally to bookings made during sale or promotional periods, and/or for otherwise discounted offers.

1.3.4 Any exceptions to the above are made at our sole discretion, and no guarantees are made beyond your rights under Australian Consumer Law.

1.4 Vouchers

1.4.1 TMT may issue and/or sell promotional vouchers at our discretion. These vouchers are promotional in nature and are not gift cards or stored-value vouchers, as they relate only to specific discounted products. Vouchers may be sold or distributed at events such as expos, promotional displays, or other locations determined by TMT. Availability of vouchers is not guaranteed, and TMT reserves the right to vary, withdraw, or cease offering vouchers at any time in accordance with limited quantities sold.

1.4.2 All promotional vouchers:

a) Apply only to the specific product(s) listed at purchase,

b) Must be redeemed via the TMT website using a unique code issued at the time of purchase,

c) Cannot be refunded or exchanged for cash,

d) May be redeemed for course bookings, subject to course availability and all conditions of this Policy regarding bookings (including cancellations, reschedules and no-shows) and licence eligibility under NT Motor Vehicle Registry (MVR) requirements,

e) Unless otherwise stated at the time of purchase, promotional vouchers are valid for 12 months from the date of purchase or issue, and

f) Are subject to the full terms and conditions displayed on the voucher at the time of sale or issue.

2. Eligibility to Transfer, Cancel or Refund Course Bookings

2.1 Transferring Bookings to Another Person

Bookings should include the correct name of the intended course attendee, entered at the time of purchase. Accurate attendee details are required for preparation of course documentation and insurance purposes. Where a booking is made on behalf of another person, their details must be provided to TMT prior to course commencement.

2.2  Minimum Notice Periods for Cancellations and Reschedules

2.2.1 Requests to cancel or reschedule a booking can be made up to 14 days before the scheduled course delivery date.

2.2.2 Less than 14 days before the scheduled course delivery date: Cancellations and reschedules cannot be accommodated within 14 days of the scheduled course. This is because your booking guarantees your place on your selected course, requiring non-recoverable costs to be committed by us, including rostering of coaches (which may include penalty rates and overtime) to meet MVR mandated instructor-student ratios, venue hire, insurances and other permits, allocation of motorcycles, and associated mechanical preparation. These expenses are locked in at least 14 days prior to each course. Cancellations within this period may also prevent minimum quotas being met, potentially leading to cancellation of the entire course for all students.

Because of these operational, regulatory and safety requirements, cancellations within 14 days of the course delivery date are not eligible for a refund, credit, or automatic reschedule. Any offer of a reschedule within this period may be made purely as a goodwill gesture at TMT’s sole discretion and is not guaranteed.

2.3  Non-Refundable and Non-Reschedule Circumstances

2.3.1 Cancellations made with less than 14 days’ notice (including non-attendance, or last minute requests made on the day of the course) are non-refundable. (See Section 2.2 for full details on minimum notice requirements). This applies irrespective of the reason given for non-attendance. Under Australian Consumer Law, businesses are not required to refund, credit, or reschedule where a customer does not attend or cancels for reasons outside the provider’s control.

2.3.2 Non-attendance (no-shows or failure to attend): For the purposes of this Policy, non-attendance means failure by the customer to be present at the published course start time for the booking they have made. Non-attendance is treated as cancellation without sufficient notice, including where a customer attempts to cancel or reschedule on the day of their course. (See Section 2.2 for full details on minimum notice requirements).

Cancellations, reschedules and refunds are not available in instances of non-attendance. This is because each booking secures an exclusive place on the selected course with non-recoverable costs incurred by us, such as payment of coaches (which may include penalty rates and overtime), allocation and preparation of motorcycles, payment of site hire, arranging of insurance or other permits, and establishing of minimum quotas for courses to run. Once a booking is made, that place is unavailable to other customers.

In line with the Australian Consumer Law, we are not required to provide a refund or reschedule where a customer does not attend for reasons outside the provider’s control. In cases of non-attendance, TMT has met its obligations by rostering qualified instructors, preparing motorcycles, securing permits, and being on site ready to deliver the course. Accordingly, 100% of the booking fee is forfeited where non-attendance occurs, regardless of reason.

2.3.3 Late Attendance: Where a student arrives late to a course, they have missed mandatory safety orientation and MVR-mandated course content and assessments. Thus, later arrivals will not be able to safely participate in the course or meet MVR requirements to receive a licence outcome. Late attendance is treated as non-attendance under this policy and is not eligible for a refund or reschedule.

2.3.4 Rider Withdrawal or Immediate Fail: During course delivery, an instructor may require a rider to withdraw from a course due to not meeting minimum competencies or requirements for safe participation, injury, or immediate fail behaviours under NT MVR guidelines. Riders may also receive a failing grade if they do not achieve the minimum assessment standards set by the MVR.

In these cases, no refund, credit, or transfer will be provided, as the place on the course has been allocated and non-recoverable costs incurred. Partial credits or partial reschedules cannot be accommodated for these reasons. Any alternative remedy offered in such circumstances would be a discretionary goodwill gesture by TMT, is not guaranteed, and does not set a precedent for future cases.

2.3.5 Voluntary withdrawal during a course, or partial attendance of a course: If a participant voluntarily withdraws from a course, class, or coaching session after it has commenced, or attends only part of the scheduled training, the booking will be treated as fully delivered. No refunds, credits, or transfers will be provided for any unused portion of the course.

2.3.6 Multi-Session Courses: If a participant withdraws part way through a multi-session course, or misses one or more sessions within a multi-session course, the missed sessions are not eligible for a refund or reschedule. This is because places on multi-session courses have already been allocated and non-recoverable costs incurred by us.

3. Requesting a Refund or Reschedule

3.1 Process

3.1.1 Submitting the request for a refund or reschedule: Refund or reschedule requests must be submitted in writing to bookings@territorymotorcycletraining.com in accordance with the required notice period, and include participant details, original booking date, and invoice number.

3.1.2. Processing time: Requests for refunds and reschedules are normally processed within two business days from receiving the request. Where refunds are approved, funds are generally returned to the account from which the purchase was made, within three business days from the date of approval by us.

3.1.3 Reschedule requests are subject to availability: Where reschedule requests are approved, the selection of the rescheduled course date and time is subject to availability. No cost is incurred by the customer for reschedule requests that comply with the minimum notice period.

3.1.4 Refund fees: For all approved refunds, an administration fee, equivalent to 10% of the total booking is non-refundable, due to transaction costs and administrative fees incurred by us in processing your refund.

3.1.5 Refund or credit method: Approved refunds will be returned to the original payment source, or an electronic credit may be issued at our discretion. Credits are valid for 12 months from the date of issue.

4. Exceptional Circumstances

4.1 Cancellation by TMT

4.1.1 Complete course cancellation: If TMT cancels a course due to unforeseen circumstances (such as weather, scheduling issues, or minimum quota numbers not being met), participants will be offered their preference of a reschedule at no additional cost, or a full refund.

4.1.2 Partial course cancellation: If a course is commenced but must be stopped part-way through due to circumstances outside TMT’s control (such as sudden weather events), TMT will arrange to complete the remaining portion at a suitable time, determined by TMT in consultation with the customer.

4.1.3 Discretionary Exceptions: Generally, exceptions are not made to this Policy, which upholds your rights under the Australian Consumer Law while protecting us from unrecoverable losses incurred when holding your place on a course. We do, however, recognise that unexpected circumstances can arise. In limited and exceptional cases, Territory Motorcycle Training may, at its sole discretion, waive or reduce cancellation fees, or relax minimum notice periods for refunds or reschedules.

Any such waiver is entirely discretionary, sits outside our obligations under Australian Consumer Law, and does not create a precedent or entitlement for future cases. We make no guarantees that such exceptions will be offered, and we are not required to provide them. We may also request reasonable supporting evidence (for example, a medical certificate) before considering or granting such an exception.

5. No Guarantee of Licensing Outcome

5.1 Role of Motorcycle Licensing Providers

Territory Motorcycle Training (TMT) delivers practical motorcycle licence courses by providing training in accordance with the NT Motor Vehicle Registry (MVR) curriculum, conducting mandatory assessments set by the MVR, and notifying the MVR of assessment results under their regulatory framework.

5.2 Role of the Regulator (MVR)

The issuing of a NT motorcycle licence is determined solely by the MVR as the regulator, in accordance with demonstrated practical competency (assessed by us) in addition to compliance with all eligibility criteria (including but not limited to age, residency status, existing licence conditions, theory tests, relevant medical or fitness requirements, and the validity of R-class learner or interim licences). TMT cannot access MVR customer records and cannot advise on or comment upon individual fitness or disqualification status, or other internal MVR determinations.

5.3 Merit-Based and Objective Assessment

TMT cannot guarantee the skills, performance, or preparedness of any individual participant. Our role is to train and assess objectively against MVR standards. Your result depends entirely on your demonstrated ability throughout all required assessments on the day. We do not provide “guaranteed pass” policies, as these can constitute misleading advertising, create a financial conflict of interest, place undue pressure on assessors, and undermine regulatory integrity. Our commitment is to fairness, objectivity, rider safety, and integrity in every assessment.

5.4 Your Obligations to Check Eligibility

While TMT may provide general information about licensing requirements, this information is indicative only and does not replace MVR guidance. It remains the participant’s responsibility to confirm their eligibility with the MVR prior to booking or attending a course with us. TMT does not accept liability for licensing ineligibility or for any failure of an individual to achieve a licence outcome.

5.5 No Requirement to Offer Refunds or Do-Overs

Refunds, credits, reschedules, or second-attempt “do-overs” will not be provided where a participant is ineligible for a licence outcome or fails to meet MVR requirements. Participants may make a new booking in the instance that another attempt is required.

These requirements are consistent with Australian Consumer Law, which does not require refunds or remedies where services are delivered as described, even if a licensing outcome is not achieved.
